3. User Accounts and Responsibilities

• Ensure you understand your physical limitations and health conditions
• Stop exercising immediately if you experience pain, dizziness, or discomfort

VyFitness and its creators assume no responsibility for injuries or health problems that may result from using the App or following workout plans within the App.

5. Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of VyFitness and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. User-Generated Content

By creating or uploading content to the App (including workout data, comments, or other information), you grant VyFitness a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute such content solely for the purpose of providing and improving our services.

You retain all ownership rights in your content and may delete it at any time. You represent and warrant that your content does not violate these Terms or infringe upon the rights of any third party.

7. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our service. By using our service, you agree to the collection and use of information in accordance with our Privacy Policy.

8. Subscription and Payments

VyFitness may offer both free and premium subscription services. Premium features require a paid subscription, which will be charged according to the billing cycle selected during signup.

Billing and Cancellation

• Subscriptions will auto-renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds are handled according to the App Store or platform policies

10. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including without limitation if you breach the Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.

These Terms shall be interpreted and governed by the laws of the jurisdiction in which VyFitness operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
